In Review
Under the Dome delivers a review of issues being considered by the West Virginia
Legislature. It provides information on matters that affect WVU and higher education,
as well as other hot topics being addressed that impact the Mountain State and
its citizens. This edition includes highlights of several bills being considered
and activities happening in Charleston as the Senate and House of Delegates enter
the final three weeks of the first session of the 86th Legislature of West Virginia.
Campus Carry
After passing the Senate 29-4 on January 24, Senate Bill 10, the Campus Self Defense Act, was considered and passed by the House Judiciary Committee last week. Faculty, student and administrative representatives were present at both the public hearing and the committee deliberations to share their concerns about the legislation and its effect on campus. The House of Delegates is expected to vote on Senate Bill 10 on Tuesday. As long as the bill remains unchanged during the amendment process and passes the House of Delegates, the bill will head to the Governor’s desk for his signature.PEIA
Senate Bill 268 would make changes to PEIA. It has passed the Senate Health Committee and now heads to the Senate Finance Committee for consideration. The bill includes provisions to raise the hospital reimbursement rate to 110% of Medicare, establish cost-share of premiums between employers and employees be 80% and 20%, implement costs for spousal coverage if an employee’s spouse has health insurance coverage elsewhere, require fiduciary training and reporting of conflict-of-interest issues for members of the PEIA finance board and conduct an actuarial study by July 1, 2024.DHHR
By a vote of 95-3, the House of Delegates has passed House Bill 2006, which would restructure DHHR into three separate departments – the Department of Health, the Depart of Human Services, and the Department of Healthcare Facilities. The bill now heads to the Senate for consideration. Members of the Senate passed a similar measure on the first day of session.Hunger Free Campus
Last week, Senate Education met and passed Senate Bill 578, the Hunger Free Campus
Act. It requires HEPC to establish a grant program to address student hunger, leverage
sustainable solutions to basic food needs, raise awareness of services currently
available and build strategic partnerships at the state, local and national level
to assist in food insecurity issues.
Institutions would qualify to be designated Hunger Free Campuses for grant funding
by:
• Establishing a Campus Hunger Task Force that meets at least three times a year
to set two goals for achievement each year;
• Assigning a staff member to help eligible students apply for SNAP benefits;
• Providing options for students to use SNAP benefits at campus stores that meet
federal standards set by the U.S. Department of Agriculture Food and Nutrition
Service;
• Participating in an awareness campaign activity during National Hunger and Homelessness
Awareness Week;
• Providing at least one physical food pantry on campus or arrange for food to be
provided to students in a stigma-free way;
• Developing a “Swipe Out Hunger” student meal credit sharing program or designating
a certain amount of free meal vouchers; and
• Conducting an annual student survey on hunger and submitting those results to HEPC
for analysis of food insecurity issues statewide.
WVU’s student leaders have been working with other student leaders, including
those at Marshall University and Concord University, on this initiative. The bill
will now head to the Senate Finance Committee for consideration.
Third Grade Success Act
Senate Bill 274, called the Third Grade Success Act, would seek to improve the proficiency of elementary school children in reading and math. Similar measures in other states have seen a significant improvement in these skills. Additionally, the bill would require early childhood classroom teaching assistants in all public first grade classes starting in the 2023-24 school year, all public second grade classes starting in the 2024-25 school year and all public third grade classes in the 2025-26 school year. The bill passed the Senate unanimously last week and now heads to the House where the House Education Committee and House Finance Committee will take up the measure.WVU Potomac State College
House Bill 3417, introduced by Delegate Gary Howell of Mineral County, would create a pilot program for WVU Potomac State College to participate in the Learn and Earn Program. The pilot would commence in the 2023-24 academic year and conclude after the 2025-26 academic year. Once completed, the Council of the Community and Technical College System would determine whether WVU Potomac State has achieved sufficient results to continue participating in the program. The bill heads to the House Economic Development and Tourism Committee.UKV Council
First established in 2016, the Upper Kanawha Valley Resiliency and Revitalization Program seeks to bring together state agencies and resources to help in improving the Upper Kanawha Valley region following the move of WVU Tech from Montgomery to Beckley. The University serves on this council and participates in efforts to improve the area. The program was set to expire on June 30, 2024, but Senate Bill 481 would extend it for five additional years by changing the sunset date to June 30, 2029. The bill passed the Senate unanimously last week and heads to the House of Delegates for consideration.Bills Introduced
